Parole Denied for 2005 DUI Deaths
On March 3, 2026, via video conference, TCDA prosecutors secured a 3-year denial of parole for Agustine Martinez Moreno, age 55, for a 2005 DUI crash that took the lives of three family members. Moreno is currently serving a life sentence at the Richard J. Donovan Correctional Facility in San Diego.
On April 8, 2005, in Woodlake, Moreno was seen by a witness doing “donuts” in his truck that was also occupied by his wife, his 7-year-old daughter, and his 3-year-old son. When involved in a minor collision, Moreno fled the scene and continued at rates of speed over 80 mph, ignoring stop lights and signs. At one intersection, Moreno swiped another car which caused his truck to strike a power pole. His wife and two children were killed in the collision. Moreno was airlifted to a hospital where his BAC registered .19% an hour after the crash. Earlier in the day prior to the crash, witnesses stated that Moreno was agitated with his family. Other family members advised them not to get in the vehicle with Moreno. At the time of the crime, Moreno possessed two prior DUI convictions.
Moreno pleaded no contest to three counts of gross vehicular manslaughter, driving with a BAC above .08%, and hit and run driving. Moreno also admitted to previous DUI convictions. In late 2006, the court sentenced him to 21 years to life in prison.
This was Moreno’s second parole hearing. At the hearing, commissioners noted Moreno’s difficulty relating to his programming and his lack of insight into potential post release plans. Moreno’s first hearing resulted in a 5-year denial of parole in 2021.
The Office of the District Attorney regularly attends life parole hearings and an Assistant District Attorney argued against the inmate’s release in this case.
